Body Navigator — Terms and Conditions

The website, software application and related services known as Body Navigator (“Body Navigator”, “the Platform”, “we”, “us”, “our”) are developed and operated by Andrew Jackson Physiotherapy, a sole trader business operated by Andrew Jackson (“the Provider”). Andrew Jackson Physiotherapy may in future incorporate as a limited company, with advance notice to Users.

Body Navigator is a Class I medical device under the UK Medical Devices Regulations 2002 (as amended), UKCA marked and self-certified by the manufacturer. It is available to clinicians in Great Britain (England, Scotland, and Wales) only. It is not currently available in Northern Ireland. By accessing and/or using Body Navigator, you (“you”, “User”, “Subscriber”) agree to be bound by these Terms and Conditions (“Terms”). You confirm that you have the power and authority to enter into, be bound by, and perform the obligations under these Terms. You must not use Body Navigator if you do not agree to these Terms.


1. Nature of the Platform and Intended Users

1.1 What Body Navigator is

Body Navigator is a clinical reasoning support and knowledge organisation tool designed to assist registered physiotherapists and other allied health professionals in retrieving and structuring relevant considerations, associations, relationships, and specialist links from a curated physiotherapy knowledge base. The platform is intended to be used as a reference and research aid alongside the clinician’s own clinical assessment and judgement. It is not a clinical decision support system, does not generate patient-specific clinical recommendations, and does not replace clinical reasoning by the registered clinician.

1.2 What Body Navigator is not

Body Navigator does not produce a diagnosis (diagnostic conclusions are formed by the clinician), does not produce a treatment recommendation specific to any individual patient (treatment decisions are made by the clinician), does not monitor patients, does not generate alerts or warnings intended to drive clinical decisions, and does not operate in any real-time or time-critical capacity. Its outputs are reference material for the clinician’s consideration, not instructions or clinical advice.

Body Navigator does not establish a clinician–patient relationship between Body Navigator and any patient, nor does it constitute the provision of healthcare to any patient. Final clinical decisions remain solely and exclusively the responsibility of the registered clinician using the Platform.

1.3 Geographic availability

Body Navigator is available to clinicians in Great Britain (England, Scotland, and Wales) only. It is not currently available in Northern Ireland. By creating an Account, you confirm that you are based and practising in Great Britain.

1.3 Intended users

Body Navigator is intended for use by registered physiotherapists and other suitably qualified allied health professionals operating within their scope of practice and the regulatory framework of their jurisdiction (including, in the United Kingdom, registration with the Health and Care Professions Council (HCPC) and, where applicable, membership of the Chartered Society of Physiotherapy (CSP)). By creating an Account, you confirm that you are such a professional and that you will use Body Navigator only within your scope of practice.


2. Accounts and Registration

2.1 Account creation

To access Body Navigator, you must register for and hold an account (“Account”). By creating an Account you confirm that you:

(a) possess the legal right and ability to enter into a legally binding agreement with us;

(b) are a registered healthcare professional acting within your scope of practice, or are acting under the lawful instruction or authority of such a professional or of a Data Controller (for example, an NHS organisation or private clinic);

(c) will use Body Navigator only in accordance with these Terms; and

(d) will not share your Account credentials or permit any other person to use your Account.

2.2 Information you provide

As part of registration, you will provide information including your full name, professional registration details, employment context, and contact details. We collect and use this information to operate the Platform, verify professional eligibility where appropriate, and as further described in our Privacy Policy.

2.3 Account security

You are responsible for keeping your username and password secure and for all use and activity carried out under your Account. You must notify us immediately at [email protected] if you become aware of any unauthorised access to or use of your Account.


3. Services

3.1 Platform overview

Body Navigator provides a multi-stage AI-supported pipeline that assists registered clinicians in:

(a) structuring clinical information from consultations or case notes;

(b) surfacing considerations across categories such as body region, anatomy, pathology, symptoms, assessment, function, health and lifestyle, wellbeing, and treatment, retrieved from a curated knowledge base;

(c) producing — at the clinician’s discretion and based on the clinician’s own ruled-in considerations — structured written outputs such as working hypotheses, prognoses, integration and monitoring plans, and clinical reasoning reports; and

(d) other related reference and reasoning-support functions as described on the Platform from time to time.

3.2 Fair use and throttling

Body Navigator uses AI processing services that incur costs per use. To ensure a fair and consistent service for all Users and to protect the integrity and availability of the Platform, we reserve the right to:

(a) apply usage limits, rate limits, or throttling to any Account — including paid subscriptions — at our sole discretion, where we consider usage to be excessive, unusual, or disproportionate relative to normal use patterns;

(b) temporarily restrict or slow access to the Platform or specific features during periods of high demand or where continued unrestricted access would adversely affect the service for other Users or the financial sustainability of the Platform;

(c) contact you to discuss your usage pattern before applying restrictions, where practicable; and

(d) define and update fair use guidelines from time to time, which will be published on the Platform or notified to you by email.

Throttling or usage limits do not constitute a breach of these Terms by us and do not entitle you to a refund of Subscription Fees, except where restrictions are so severe and prolonged as to render the Platform materially unusable for its intended purpose, in which case you may terminate your Account and receive a pro-rata refund of fees paid in advance for the unused period.

3.3 Updates to the Platform

We may, in our sole discretion, change, update, add to, or remove functions of Body Navigator. New functions or significant updates may be subject to additional terms or fees, which will be notified to you in advance.

3.3 Term

These Terms commence when you first access Body Navigator and continue until terminated in accordance with these Terms.


4. Fees and Payments

4.1 Subscription fees

Access to Body Navigator may require payment of a subscription fee at the rate published on the Platform or otherwise agreed with you (“Subscription Fee”), payable in advance for the relevant subscription period (“Subscription Period”). All fees are stated in British pounds unless otherwise indicated and are exclusive of VAT where applicable.

4.2 Renewal and cancellation

Your subscription will automatically renew at the end of each Subscription Period unless you cancel before the end of the then-current Subscription Period. Cancellation takes effect at the end of the current Subscription Period. We do not provide refunds or credits for any partial Subscription Period except as expressly stated in these Terms or as required by law.

4.3 Variation of fees

We may vary the Subscription Fee on reasonable advance notice, with the varied fee taking effect at the start of your next Subscription Period.

4.4 Non-payment

We may suspend or terminate your Account where Subscription Fees are not paid when due.


5. Privacy and Data

5.1 Privacy obligations

Each party must, in performing these Terms, comply with all applicable privacy and data protection laws, including the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and any equivalent laws applicable in your jurisdiction.

5.2 Patient data and consent

You are solely responsible for ensuring that:

(a) you have the lawful basis and, where required, the consent of patients to input their personal data or special category (health) data into Body Navigator;

(b) any input of data into the Platform is consistent with the data protection policies and agreements of any organisation under whose authority you are acting (for example, your employer or contracting NHS body); and

(c) you comply with all applicable professional record-keeping, confidentiality, and data-handling obligations.

5.3 Our role

In respect of patient data you input into Body Navigator, you act as Data Controller and Body Navigator acts as Data Processor on your behalf, in accordance with our Privacy Policy and the Data Processing Agreement that forms part of your contract with us.

5.4 Privacy Policy

Our collection, use, storage, and disclosure of personal data are described in our Privacy Policy at https://thebodynavigator.com/privacy-policy/. By using Body Navigator, you acknowledge that you have read and understood the Privacy Policy.

5.5 De-identified data

We may de-identify and aggregate data (excluding identifiable patient health information) for the purposes of:

(a) maintaining, improving, and evaluating the Platform;

(b) developing new functionality;

(c) ensuring quality, safety, and accuracy of the Platform;

(d) research and analytics relating to the performance of the Platform; and

(e) other purposes set out in our Privacy Policy.

We will take reasonable steps to ensure that de-identified data cannot be reverse-engineered or linked back to you or to any patient.

5.6 No training on identifiable patient data

We will not use identifiable patient health information that you input into Body Navigator to train third-party large language models, except where you have provided explicit, informed consent or where such use is otherwise lawful and disclosed in our Privacy Policy.


6. Use of Body Navigator

6.1 Your obligations

You must:

(a) comply with all applicable laws, regulations, and professional obligations (including those of the HCPC, CSP, or equivalent regulatory body in your jurisdiction) in connection with your use of Body Navigator;

(b) use Body Navigator only within your scope of professional practice;

(c) obtain all necessary patient consents required under applicable law and professional standards before inputting patient information into the Platform;

(d) maintain the confidentiality of patient information and your Account credentials;

(e) cooperate with reasonable directions from us in relation to your use of the Platform;

(f) notify us promptly if you become aware of any defect, error, or safety issue with the Platform; and

(g) maintain accurate and complete clinical records consistent with your professional obligations, independently of and in addition to any outputs generated by Body Navigator; and

(h) inform patients when Body Navigator outputs have informed their care, and respect any patient preference not to have AI tools used in their care planning, in accordance with your professional obligations and the CSP’s AI principles.

6.2 Restrictions

Except as permitted under these Terms, you must not:

(a) distribute, sub-license, transfer, or grant access to the Platform to any other person;

(b) attempt to disassemble, decompile, or reverse-engineer the Platform, except as permitted by applicable copyright laws;

(c) alter, customise, modify, or create derivative works based on the Platform or its outputs in a manner that misrepresents their source;

(d) use the Platform to provide a clinical decision support, AI scribing, or competing service to third parties;

(e) extract, scrape, or copy the underlying clinical knowledge base;

(f) supply inaccurate, fraudulent, or deliberately misleading data to the Platform;

(g) input patient data without the necessary lawful basis or consent;

(h) use the Platform in any way that would have an adverse impact on the reputation of Body Navigator or that breaches any applicable law; or

(i) hold the Platform out to patients or any other party as constituting medical advice or diagnosis.


7. Clinical Use and Limitations

7.1 Clinical decision-making remains with you

You acknowledge and agree that:

(a) Body Navigator is a clinical reasoning support and knowledge organisation tool only. It is not intended to be used to take decisions for diagnostic or therapeutic purposes within the meaning of the UK Medical Devices Regulations 2002 (as amended). All clinical decisions — including assessment, diagnosis, treatment selection, prognosis, onward referral, and discharge — must be made by you, in the exercise of your independent professional judgement, taking account of the individual patient in front of you;

(b) the Platform may be used either as a reference resource only — where you read the category reports and form your own clinical reasoning independently, with no synthesised output produced by the Platform — or, at your discretion, with the Platform’s optional structured synthesis tools, which operate only on the considerations you have explicitly ruled in and prioritised. In neither mode does the Platform perform clinical reasoning of its own;

(c) where you use the optional structured synthesis tools, any synthesised output — including any working hypothesis, prognosis, or clinical reasoning report — is derived only from the considerations you have ruled in, in the order you have prioritised them, and constitutes a structured articulation of your own clinical reasoning rather than independent clinical advice from the Platform;

(d) outputs of Body Navigator are intended to inform and structure your clinical reasoning, not to replace it;

(e) you must critically review every output produced by the Platform before relying on, sharing, or acting upon it; and

(f) you must not represent to patients or any third party that an output of Body Navigator constitutes medical advice, a diagnosis, or a treatment plan in itself.

7.2 Nature of AI-generated outputs

You acknowledge that Body Navigator uses artificial intelligence, large language models, and a retrieval-augmented generation (RAG) pipeline. Due to the probabilistic nature of these technologies, outputs:

(a) may contain inaccuracies, omissions, hallucinations, or content that is inappropriate to the clinical context;

(b) may not reflect the most current evidence base in every case;

(c) may misinterpret or misweight inputs you provide; and

(d) may produce different outputs from the same or similar inputs.

It is your responsibility to evaluate every output for clinical accuracy and appropriateness before use.

7.3 Knowledge base and references

The clinical knowledge base used by Body Navigator has been curated by experienced clinicians and is regularly developed and refined. However:

(a) the knowledge base is not exhaustive and is not a substitute for current peer-reviewed literature, clinical guidelines, or specialist advice;

(b) any references or citations produced in outputs should be independently verified before being relied upon in clinical documentation, communications with other professionals, or medico-legal contexts; and

(c) inclusion of a framework, model, or treatment approach in the knowledge base does not constitute an endorsement of its use in any particular clinical situation.

7.4 Notification of safety concerns

You must notify us promptly at [email protected] if you become aware of:

(a) any output that has caused, or could reasonably have caused, harm to a patient or other person;

(b) any defect, deficiency, or potential deficiency in the safety, quality, or performance of the Platform; or

(c) any incident or near-miss that you consider relevant to the safe operation of the Platform.


8. Intellectual Property

8.1 Our intellectual property

Unless otherwise indicated, we own or license all rights, title, and interest (including copyright, designs, patents, trademarks, database rights, and other intellectual property rights) in:

(a) the Body Navigator platform, software, and source code;

(b) the structured prompt suite and underlying prompt architecture;

(c) the curated clinical knowledge base, including its structure, taxonomy, organisation, and the selection and arrangement of its contents;

(d) all branding, logos, and visual identity elements; and

(e) all other content made available through the Platform (together, the “Body Navigator Content”).

8.2 Licence to you

We grant you a limited, non-transferable, non-exclusive, revocable licence to access and use Body Navigator and Body Navigator Content for the duration of these Terms, solely for the purpose of supporting your delivery of healthcare services to your own patients within your professional practice. You may not use the Platform or Body Navigator Content for any other purpose, including reselling, redistributing, or building competing services.

8.3 Outputs

Subject to these Terms, you own the clinical content of outputs generated through your lawful use of Body Navigator that relate to your patients and your practice, to the extent that such outputs are based on your inputs. We retain all rights in the underlying templates, prompt structures, knowledge base content, and platform components used to produce those outputs.

8.4 Feedback

If you provide feedback, suggestions, enhancement requests, or ideas to us, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable licence to use that feedback to improve and develop the Platform, without restriction and without payment.

8.5 Third-party content

The Platform may incorporate or reference content, frameworks, or works owned by third parties. Your use of such content is subject to any additional terms notified to you and to applicable copyright law. Citation of authors, frameworks, or published works within outputs does not imply endorsement by those authors of Body Navigator or its outputs.


9. Confidentiality

9.1 Confidential Information

“Confidential Information” includes any information of a confidential nature disclosed by us, or learned, accessed, or generated by you as a result of using Body Navigator, including the structure of the knowledge base, the prompt architecture, the design of the pipeline, and any non-public technical or commercial information.

9.2 Your obligations

You must:

(a) hold Confidential Information in strict confidence;

(b) not disclose Confidential Information except to personnel who need to know and who are bound by equivalent obligations of confidence, or as required by law; and

(c) take all reasonable steps to protect Confidential Information from unauthorised disclosure, including the steps you take to protect your own confidential information.

9.3 Breach notification

You must notify us promptly of any actual or suspected breach of confidence or security incident in relation to Body Navigator or your Account.


10. Third-Party Services and Resources

10.1 Third-party functionality

The Platform uses or integrates with software, services, or content provided by third parties (for example, vector database providers, large language model providers, hosting providers, or transcription services). Your use of such third-party functionality may be subject to additional terms notified to you. The sub-processors used by the Platform are listed in our Privacy Policy and Data Processing Agreement.

10.2 Linked resources

The Platform may contain links to external websites, journals, guidelines, or resources. We do not endorse and are not responsible for the content, accuracy, or availability of any third-party resources.


11. Suspension and Termination

11.1 Suspension

We may restrict, suspend, or limit your access to the Platform, with prior notice where practicable, including for scheduled maintenance, where we reasonably suspect breach of these Terms, or where we believe suspension is necessary to protect the integrity or security of the Platform or its users.

11.2 Termination by you

You may terminate your subscription by cancelling through your Account settings or by emailing [email protected].

Cancelling your subscription (non-renewal of your monthly or annual payment) does not close your Account and does not delete your data. Your case data remains intact during any period where your subscription is lapsed, so that it is available to you if you choose to resubscribe. Access to the Platform’s features will be restricted during a lapsed subscription in accordance with the plan terms.

Closing your Account is a separate action — a deliberate request to terminate your Account entirely and have your data deleted. You may request Account closure by emailing [email protected]. On Account closure, we will delete your personal data without undue delay and in any event within one month, subject to data we are legally required to retain (such as billing records).

You may also request deletion of your data at any time, without closing your Account, by exercising your right to erasure under section 11 of the Privacy Policy.

11.3 Data export

You may at any time request an export of your case data held on the Platform in a structured, commonly used format. To request an export, email [email protected]. We will provide the export without undue delay and in any event within one month of your request. This right exists regardless of your subscription status and is in addition to your rights under UK GDPR as described in our Privacy Policy.

11.5 Effect of termination

We may terminate these Terms and your Account where:

(a) we reasonably believe you have breached these Terms;

(b) we withdraw the Platform from market (in which case you will receive a pro-rata refund of fees paid in advance for the unused portion of your Subscription Period);

(c) you cease to be eligible to use the Platform (for example, loss of professional registration); or

(d) we consider it reasonably necessary to comply with applicable law.

11.4 Effect of termination

On termination:

(a) you must pay any outstanding fees due;

(b) the licence granted under clause 8.2 ceases and you must cease using the Platform and Body Navigator Content;

(c) you must, on request, return or destroy any Confidential Information in your possession;

(d) we may, in our discretion and subject to law, delete any data or materials held in your Account; and

(e) accrued rights and provisions intended to survive termination (including clauses 5, 8, 9, 12, 13, 14, and 15) will continue.


12. Disclaimer

12.1 “As is” basis

To the maximum extent permitted by law, Body Navigator, Body Navigator Content, and related services are provided “as is” and “as available”, without warranty or guarantee of any kind, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

12.2 No clinical warranty

Without limiting clause 12.1, we do not warrant that:

(a) outputs of the Platform are accurate, complete, or appropriate to any particular patient or clinical situation;

(b) the Platform will be uninterrupted, error-free, or secure;

(c) defects in the Platform will be corrected;

(d) any references or citations within outputs are accurate or up to date; or

(e) the Platform reflects the most current evidence base, clinical guidelines, or regulatory standards.

12.3 Reliance

You rely on the Platform and its outputs entirely at your own professional risk. You remain solely responsible for all clinical decisions and for the safety, quality, and appropriateness of the care you provide to patients.


13. Liability

13.1 Excluded liability

To the maximum extent permitted by law, we will not be liable for:

(a) any clinical outcome, patient harm, misdiagnosis, missed diagnosis, or delay in diagnosis or treatment;

(b) any indirect, consequential, special, exemplary, or punitive loss or damage;

(c) loss of profits, revenue, business, anticipated savings, goodwill, or reputation;

(d) loss or corruption of data, however caused;

(e) loss arising from unauthorised access to or alteration of data or materials by third parties;

(f) loss arising from interruption, unavailability, or degradation of the Platform; or

(g) loss arising from any inaccuracy, incompleteness, or inappropriateness of any output of the Platform.

13.2 Liability cap

Without limiting clause 13.1, our total aggregate liability to you in connection with these Terms, the Platform, and related services (whether in contract, tort including negligence, breach of statutory duty, or otherwise) in any consecutive twelve-month period is limited to the total Subscription Fees actually paid by you to us during that period.

13.3 Liability not excluded

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.


14. Indemnity

You agree to indemnify and hold us harmless against all losses, costs, expenses, damages, claims, demands, and liabilities (including reasonable legal fees) we incur arising out of or in connection with:

(a) any breach by you of these Terms;

(b) any clinical act or omission by you, including any claim made by a patient relating to your assessment, diagnosis, treatment, or use of any output of the Platform;

(c) your breach of any applicable law (including data protection or privacy laws), professional duty, or contractual obligation to a third party (such as an employer or contracting NHS body);

(d) your input into the Platform of any data without lawful basis or appropriate consent;

(e) any wilful, unlawful, fraudulent, or negligent act or omission by you or your personnel; or

(f) any infringement by you of intellectual property rights in connection with the Platform or its outputs,

except to the extent such loss is caused by our own wilful misconduct or unlawful act.


15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. You and we agree to submit to the non-exclusive jurisdiction of the courts of England and Wales for the resolution of any dispute arising out of or in connection with these Terms.


16. Updates to these Terms

We may modify these Terms from time to time. Where changes are material, we will provide reasonable advance notice (where practicable, at least 30 days) via the Platform, by email, or by another reasonable method. If a change materially and detrimentally affects your rights, you may terminate your Account during the notice period and receive a pro-rata refund of any Subscription Fees paid in advance for the unused portion of the Subscription Period. Continued use of the Platform after the effective date of the change constitutes acceptance of the updated Terms. 17. General

17.1 Independent contractors

Each party acts as an independent contractor. Nothing in these Terms creates a partnership, joint venture, agency, employment, or fiduciary relationship between us.

17.2 Assignment

Your Account is personal to you. You may not assign, transfer, sub-license, or sub-contract your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations on reasonable notice to you.

17.3 Force majeure

Neither party will be liable for failure to perform any obligation (other than payment) to the extent such failure results from events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, failure of utilities or telecommunications networks, or third-party service outages.

17.4 Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will continue in full force.

17.5 No waiver

A failure or delay by us in exercising any right under these Terms does not constitute a waiver of that right.

17.6 Entire agreement

These Terms, together with the Privacy Policy, the Data Processing Agreement, and any additional terms expressly incorporated by reference, constitute the entire agreement between us relating to the Platform and supersede any prior agreement or understanding.

17.7 Notices

Notices to us must be sent to [email protected]. Notices to you may be sent via the Platform, by email to the address registered to your Account, or by post.

17.8 Third-party rights

A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
